Attorney Fennick Wins Case Against York College of Pennsylvania

Attorney Daniel Fennick recently successfully represented a former student who attended York College of Pennsylvania in a case against the school. The defendant charged Attorney Fennick’s client with a violation of the school’s code of conduct for matters related to violations of the alcohol policy, parking enforcement, and safety. The plaintiff was excluded from a portion of her disciplinary hearing, which had a significant impact on her ability to effectively state her case and appeal the board’s decision. Additionally, when the plaintiff did file her appeal, she did not know the evidence that was brought against her.

The court concluded that while the plaintiff will not be able to be readmitted to the school, they can award relief to the plaintiff. Additionally, Attorney Fennick was able to assist his client in having disciplinary actions based on an initial disciplinary hearing vacated, which ultimately allowed his client to be afforded a new disciplinary hearing that is consistent with the opinion of the court.
